1. Scope
These Terms and Conditions apply to the use of the web application BirdieBet (birdiebet.eu), operated by Design Spark, Julius Uelschen, Isidorweg 4, 33161 Hövelhof, Germany. By registering, the user accepts these terms.
2. Service Description & Platform Nature
BirdieBet is a digital score tracking and analysis tool for golf rounds. The platform enables recording scores, calculating competition results, and creating leaderboards. BirdieBet is expressly not a gambling platform and does not facilitate gambling in any legal sense. No real money stakes are processed, facilitated, or managed through the platform. All competition stakes are displayed in a virtual points currency that has no monetary value. The use of points serves exclusively for playful evaluation within the platform.
3. Registration & User Account
A registration with a valid email address is required for use. The user is responsible for the accuracy of their information and the security of their login credentials. Each user may only have one account.
4. Subscriptions & Payments
BirdieBet offers various subscription plans (Solo, Team, Enterprise). Payments are processed via Stripe. Monthly subscriptions can be cancelled at the end of the month. Annual plans are prorated. A 14-day free trial period applies.
5. Points System
The points used in BirdieBet are a virtual unit with no monetary value. They serve exclusively for evaluation and comparison within golf rounds and tournaments. Points cannot be exchanged for money, paid out, or transferred to third parties. BirdieBet is not responsible for private arrangements between users outside the platform.
6. No Gambling
BirdieBet does not constitute gambling or sports betting in any legal sense. The platform does not process monetary payments between users and does not offer opportunities to win real money. BirdieBet functions exclusively as a tracking and analysis tool. All competitions and results displayed on the platform are based on a virtual points system with no real-world value.
7. Liability
BirdieBet is not liable for the accuracy of scores and results entered by users. The platform is provided without guarantee of availability. BirdieBet is only liable for damages arising from the use of the platform in cases of intent and gross negligence.
8. Termination
Either party may terminate the user relationship at any time. Upon termination, user data will be deleted after the expiry of statutory retention periods. A right to data export exists during the active subscription.
9. Changes to Terms
BirdieBet reserves the right to amend these terms as needed. Material changes will be communicated to users by email. Continued use after the changes take effect constitutes acceptance.
10. Applicable Law & Jurisdiction
The laws of the Federal Republic of Germany apply. The place of jurisdiction is, to the extent permitted by law, Paderborn.
